NOTICE OF PUBLIC HEARING

 PLEASE TAKE NOTICE, that the Nassau Village Board of Trustees shall hold a public hearing on March 9, 2022 at 7:15 p.m., at the Village Hall, 40 Malden Street, Nassau, New York to receive comments from the public about a proposed local law as follows:

Proposed Local Law No. 1 of the year 2022, a local law amending Section 120-36(A) of the Zoning Law of the Village of Nassau, to include a cannabis dispensary among the defined uses for which a special permit is required in the General Business District.

Article 8 of the Nassau Village Zoning Law sets forth land use rules and regulations for the General Business District Zone. That local law sets forth permitted principal uses (Section 120-34); permitted accessory uses (Section 120-35) and special permit uses (Section 120-36). Section 120-36 sets forth a specific list of land uses for which a special permit must be obtained from the Planning Board. That list currently includes bars and taverns, automobile sales areas, light industrial facilities, and other uses. Under the new Cannabis Law enacted by the State of New York in 2021, it is possible that a cannabis dispensary could be opened within the Village borders. The proposed local law would add cannabis dispensary to the list of uses requiring a special permit, thus providing for a review of the application for the establishment of any such business within the Village by the Village Planning Board.

A copy of the local law may be inspected at the Office of the Village Clerk during regular business hours. A copy of the proposed local law is also available on the Village’s website at: www.villageofnassau.gov

Written comments may be submitted to the Village Board by mail to the Village Board, Nassau Village Hall, 40 Malden Street, P. O. Box 452, Nassau, New York 12123 at any time prior to the hearing.

NOTICE OF ADOPTION OF A LOCAL LAW BY THE BOARD OF TRUSTEES OF THE VILLAGE OF NASSAU SUBJECT TO A PERMISSIVE REFERENDUM

NOTICE OF ADOPTION OF A LOCAL LAW BY THE BOARD OF TRUSTEES OF THE VILLAGE OF NASSAU SUBJECT TO A PERMISSIVE REFERENDUM

             PLEASE TAKE NOTICE that on December 22, 2021, the Village Board of the Village of Nassau adopted a certain local law as follows:

A local law opting out of on-site cannabis consumption sites in the Village of Nassau as authorized under Cannabis Law Article 4.

The Cannabis Law of the State of New York adopted in 2021 authorizes the establishment of licensed dispensaries of cannabis, and also licensed on-site cannabis consumption sites within the State of New York. Pursuant to that law, municipalities, including villages, were given the option to opt out of the State licensing of facilities within their jurisdiction. By the local law adopted above, the Village of Nassau opted out of allowing on-site cannabis consumption sites from being established and operated within the jurisdiction of the Village of Nassau. Pursuant to that local law, the State Board will not license such facilities within the Village of Nassau.

The resolution adopting this local law is subject to a permissive referendum, pursuant to the provisions of the Village Law.

PRESS RELEASE – CANNABIS OPT-OUT

For Immediate Release

On December 22, 2021, the Village of Nassau Board of Trustees held public hearings to get input from residents on local laws to opt out of allowing adult-use cannabis retail dispensaries and on-site consumption licenses from locating within the Village limits. In a special meeting immediately following the public hearings, the Board of Trustees unanimously voted to defeat the law opting out of cannabis retail dispensaries. This means that retail dispensaries will be allowed in the Village of Nassau. The Board also unanimously voted in favor of opting out of on-site consumption lounges for the time being due to lack of clarity on the operation and regulations surrounding said lounges. The Board of Trustees thanks all who provided input as it considered action on these matters.
